FACTS

Mr Opie Bosson admitted a breach of Careless Riding following the running of Race 7.

The carelessness being that near the 700m, he allowed his mount ‘SWEET TALKING’ to shift in when not sufficiently clear of ‘STAR TRAIL’ (A Goindasamy), which was dictated inwards checking ‘DIAMONDS FOR JEN’ (T Thornton).

Mr Bosson said that he understood the charge, Rule and confirmed to the Adjudicative Committee that he admitted the breach of the Rule.

Mr Jones showed film replays, identified all three runners and showed where the interference occurred.  He said that when Mr Bosson shifted in, he was only one length clear of ‘STAR TRAIL’.  He said that Mr Bosson did come off, but it was a stride or two too late.

Mr Bosson, for his part, said that his mount was a difficult ride as it wanted to lay in from the start of the race.  He added that ‘STAR TRAIL’ did not help his cause as it ran away from his horse.

DECISION

As the charge was admitted, it was deemed proved by the Adjudicative Committee.

PENALTY SUBMISSIONS

Ms Selvakumaran gave Mr Bosson’s record that showed three careless riding suspensions during the last 12 months:

15 October 2022      –           6 weeks Suspension & $1000 Fine

12 October 2022      –           5-days Suspension

19 February 2022    –           5-days Suspension

During the last 12 months, Mr Bosson has had 370 rides.

The Stewards placed the carelessness in the mid-range area.

Mr Bosson asked that any suspension imposed starts after 11 February 2023.

REASONS FOR PENALTY

The Adjudicative Committee placed the carelessness in the mid-range category also, and considering the starting point of 7-days suspension, record and admission of the breach, it was determined that a suspension of 6-Riding Days was an appropriate penalty.

CONCLUSION

Mr Bosson’s Jockey’s Licence was suspended from end of racing on 11 February through to 23 February 2023 inclusive (6 National Days).
