FACTS

Following Race 6, Ms Burley admitted a breach of Rule 869(2) & the Whip & Rein Regulations when driving “I EXPECT BETTOR”.

Ms Burley assisted by Ms Chilcott, said that she understood the Rule, charge and confirmed that she admitted the breach.

Film replays were shown, which clearly showed Ms Burley using the whip in breach of the Rule several times.

Ms Burley said that she became excited as it was a close finish.

DECISION

As the charge was admitted, it was deemed proved.

PENALTY SUBMISSIONS

Mr Williams said that Ms Burley had had 12 raceday drives with one prior whip warning.

He referred to the Penalty Guide and said that the Stewards placed the breach in the mid-range category.

Ms Burley indicated that she would prefer a suspension.

REASONS FOR PENALTY

The Penalty Guide starting point for a mid-range breach of the Rule is a fine of $500 or a 2-day suspension.

The Adjudicative Committee determined that a 2-day suspension was a suitable penalty.

CONCLUSION

Ms Burley’s Driver’s Licence was suspended from 5 February to 14 February 2023 inclusive.
