FACTS

Following Race 5, Ms A Harrison admitted a breach of Rule 869(2) & the Whip & Rein Regulations.

It was alleged that Ms Harrison, when driving “ACE STRIKE”, used her whip with more than a wrist flicking motion in the home straight.

Ms Harrison, in the presence of Ms Chilcott, said that she understood the Rule, charge and confirmed that she admitted the breach.

Film replays were shown with Mr Mulcay identifying where the whip was used above an angle of 45 degrees.

Ms Harrison and Ms Chilcott said that it was only used in that manner during the final 50m.  They said that up until then, the whip use had been acceptable.

DECISION

As the charge was admitted, it was found proved.

PENALTY SUBMISSIONS

Ms Harrison had a clear record, with Mr Mulcay referring to the Penalty Guide.

The starting point for a first breach is a fine of $300 or 3-days suspension.

Ms Harrison asked that a fine be imposed.

REASONS FOR PENALTY

The Adjudicative Committee determined that a fine of $300 was an appropriate penalty.

CONCLUSION

Ms A Harrison was fined $300.
