Penalty: Junior Driver Sheree Tomlinson fined $200

Evidence:

Mr Munro alleged that Ms Tomlinson (DODGETHEBULLET) used her whip with more than a wrist flicking motion leaving the final bend and in the early stages of the home straight.

Mr Munro identified the Respondent’s horse on the video and demonstrated that as the field rounded the bend and raced into the home straight Ms Tomlinson, who was 3 wide, was urging her horse. Mr Munro stated that Ms Tomlinson used the whip with one hand free of the reins. There were 6 strikes.

Ms Tomlinson said the horse was a “bludger” and she was wanting to get the best out of it. She had thought at the time that she was driving within the Rules.

Reasons for Decision:

As Ms Tomlinson has admitted the breach, it is found to be proved.

Submission for Penalty:

Mr Munro produced the Respondent’s record which was clear under the Whip Rule.  Ms Tomlinson has had 564 drives this season and 433 the last. Mr Munro described the breach as low end.

Ms Tomlinson did not disagree with this and asked that her good record be considered.

Reason for Penalty:

The breach is low end and Ms Tomlinson’s record under this Rule is very good these past 12 months.

Conclusion:

She is fined the sum of $200 as per the Penalty Guide.
