Background:
Following the running of Race 8, the ‘Entain/NZB Insurance Pearl Series Maiden’ an Information was lodged alleging a breach of Rule 638(1)(d). Details are as follows:
‘in that E Sole (Keen on Bubbles) shifted outwards entering the home straight checking Five Bells (K Chowdhoory)’
Ms Sole confirmed to the Adjudicative Committee that she understood the Rule and admitted the breach. This was endorsed by Ms Clapperton.
Rule 638(1)(d) provides:
(1) A Rider shall not ride a horse in a manner which the Adjudicative Committee considers to be…
(d) careless
Evidence:
Using available film, Stewards identified the incident. Approaching the home turn, KEEN ON BUBBLES was positioned two back and one off the fence. As the field straightened, Ms Sole is seen to angle her horse out. In doing so, she is insufficiently clear of FIVE BELLS, who as a result is checked, thus losing ground. When asked, Ms Sole did comment that there was a gap closer to the fence, but she chose to move out. Ms Clapperton added that the move reflected inexperience and that she had gone a little early.
Decision:
As the Respondent admitted the breach, the Adjudicative Committee found the breach proved.
Submissions for Penalty:
Stewards outlined that the Respondent’s record is clear as it relates to any breach of Rule 638(1)(d) within the last twelve months. Ms Sole has only just begun her career, noting that in the recently completed season, she had 65 rides and rode 8 winners. Stewards contended that the breach sat at the low range. Ms Sole advised that if a suspension was imposed, it could take effect immediately.
Reasons for Penalty:
The incident was identified by film to the satisfaction of the Adjudicative Committee. In setting Penalty, the Adjudicative Committee referred to the current NZTR Guide. A suspension of 5 days was imposed, reflecting that in the view of the Adjudicative Committee, her actions did also contribute to a check suffered by TRICK THIMBLE (Kevin Kalychurun). Record and status was also acknowledged.
Conclusion:
The Respondent’s Licence to ride in races is suspended for 5 NR Days. Suspension is to take effect from close of racing on 4 August 2024, up to and including 11 August 2024.
