FACTS

Ms Fawcett admitted a breach of Rule 330(3)(a) in that she broke a riding engagement for ‘GO BRO’ in Race 9 without reasonable cause.

As Ms Fawcett had left the course, she was contacted by telephone.  She admitted the breach and was happy for the hearing to proceed with her contact being by telephone.

Ms Selvakumaran said that Ms Fawcett’s Manager did accept the ride on ‘GO BRO’ on her behalf.  She added that Ms Fawcett left the course without Stewards’ approval.

Ms Fawcett said that she thought that she did not have a ride, should have checked and that it was negligence on her part, hence the reason she admitted the breach.

DECISION

As the breach was admitted, it was deemed proved.

PENALTY SUBMISSIONS

Ms Selvakumaran advised that similar breaches had been met with fines of $150 – $350, however she said an aggravating factor was that Ms Fawcett left the course without obtaining approval.

Ms Fawcett did not comment regarding penalty.

REASONS FOR PENALTY

It was Ms Fawcett’s obligation to check what riding engagements she had for the day and also to obtain Stewards’ approval to leave the course.  If she had have done so, the Stewards would have brought to her attention that she had one more riding engagement to fulfill.

Taking all matters into consideration, a fine of $400 was deemed appropriate.

CONCLUSION

Ms J Fawcett was fined $400.
