EVIDENCE:

Following Race 6 Information A15949 was filed with the Adjudicator.  It was alleged that Mr Alam used his whip 6 times prior to the 100m when riding “MR RAINBOW”.

Mr Alum said that he understood the Rule, Charge and confirmed that he admitted the breach.

Mr Jones showed the film replays and identified where Mr Alum struck his horse 6 times with the whip.

 Mr Alum agreed it was 6 times.

REASON FOR DECISION:

As Mr Alam admitted the charge it was found proved.

SUBMISSION FOR PENALTY:

Mr Jones said that it was Mr Alam’s first whip charge and made reference to the Penalty Guide.

 Mr Alam did not comment.

REASON FOR PENALTY:

As there was not any reason to depart from the Penalty Guide starting point of $250 that figure was considered a suitable penalty.

CONCLUSIONS:

Mr Alam was fined $250.
