BACKGROUND:
Following the running of Race 8, Chief Stipendiary Steward, Mr Nigel McIntyre presented an Information alleging a breach of Rule 869(7A)(a) by Driver, Ms Katie Cox.
Ms Cox stated she understood the Rule and the charge and confirmed she denied the breach.
Rule 869 (7A) (a) provides:
(7A) Every driver who moves inwards shall ensure:
(a) that contact is not made with any track marker.
EVIDENCE:
Mr McIntyre showed the video of the horses entering the final straight to show Ms Cox racing 3 back on the markers. He pointed to Ms Cox’s sulky stay strike the final pylon. He said that was all the Stewards evidence.
Ms Cox used the video to point out her sulky wheel had missed the pylon and it was only because the pylon was slightly bent that her stay has made contact.
Mr McIntyre in summing up said it was a matter of strict liability. He said the Rule states, “that contact is not made with any track marker“. He said this means with horse , wheel , stay or any other part or combination.
REASONS FOR DECISION:
The video supported Mr McIntyre’s observation of the incident, Ms Cox has made contact with the final pylon.
SUBMISSIONS FOR PENALTY:
Mr McIntyre stated Ms Cox was warned on Friday night 17 March 2023 hence the charge being presented today. He said the Stewards would be seeking a fine of $100.
Ms Cox made no submissions on penalty.
REASONS FOR PENALTY;
This type of incident is soon to be covered by the MIN regime and the Adjudicative Committee considers a $100 fine appropriate.
CONCLUSION:
Driver, Katie Cox is fined $100.
