Evidence

Following the running of Race 3, the Respondent Billy Jacobson, Rider, admitted a charge alleging excessive whip use prior to the 100 metres.

Rule 638(3)(g)(i) provides that in a Flat Race a Rider must not:

(i) strike a horse with a whip more than 5 times prior to the 100-metre mark (other than in a slapping motion down the shoulder with the whip hand remaining on the reins);

Using the available race films, Mr Jones demonstrated that the Respondent struck his mount 8 times from the straight entrance to the 100-metre mark.

In response, by way of explanation, Mr Jacobson said he was doing his best to adjust his whip action, and he was racing in tight quarters.

Decision

As the Respondent admitted the breach, the Adjudicative Committee finds the breach proved (Rule 915(1)(d) refers).

Submissions for Penalty

Mr Jones produced the Respondent’s record which indicated a clear record. Mr Jones said that the Penalty Guide provided for a $500 fine for 3 additional strikes over the 5 strike limit.

Mr Jacobson offer no comment in regard to penalty submissions.

The Adjudicative Committee passed comment to Mr Jacobson, that several of the strikes looked very close to also being above shoulder height.

Reasons for Penalty

The films were clear, the Respondent did strike his mount 3 times over the allowable limit.

On that basis, the Respondent is fined $500.

The Respondent is fined $500.
