Evidence
Following the running of Race 7, the Respondent Ashvin Goindasamy admitted a charge alleging excessive whip use prior to the 100 metres.
Apprentice Mentor Noel Harris was present to assist.
Rule 638(3)(g)(i) provides that in a Flat Race a Rider must not:
(i) strike a horse with a whip more than 5 times prior to the 100-metre mark (other than in a slapping motion down the shoulder with the whip hand remaining on the reins); or
Using the available race films, Mrs Selvakumaran demonstrated that the Respondent struck his mount 6 times from the straight entrance to the 100-metre mark.
In response, by way of explanation, the Respondent said after he applied the whip on the first occasion, he got dictated to by a horse on his inner, that shifted out in front of him and as a result of him steering away from that horse, he lost count as to his strikes.
Mr Harris said that Pukekohe had a long straight and often this caught out the Apprentices.
Decision
As the Respondent Mr Goindasamy admitted the breach, the Adjudicative Committee finds the breach proved (Rule 915(1)(d) refers).
Submissions For Penalty
Mr Jones produced Mr Goindasamy’s record which indicated 1 previous breach in the previous 6 months. He said that as the breach had occurred in a Group 3 race, that the Guidelines pointed to a penalty starting point of 50% of the Rider’s stake money earned.
The Respondent’s share of the stake (Apprentice Rider) was $1,725.
Reasons For Penalty
The Penalty Guide starting point for a breach of this nature is $250. In a Black type race the starting point for a fine is 50% of the Jockey’s stake money earned, this may be in addition to any suspension incurred.
After considering the film evidence, the submissions and having due regard for the number and frequency of strikes, the force used, the Respondent’s share of stake and the Group 3 status of the race, the Adjudicative Committee determined there are no compelling reasons to depart from the starting point set out in the Penalty Guide.
On that basis the Respondent is fined $850.
Conclusion
Mr Goindasamy is fined $850.
