Penalty: Driver Zachary Butcher is fined $200

Mr Mulcay alleged that Mr Butcher (ULTIMATE MISSILE) used his whip in more than a wrist flicking motion in the run home in Race 1.

Mr Mulcay demonstrated on the videos that the Respondent, when making a run to the outside of the track, used his whip in more than a wrist flicking manner. He emphasised the whip use was not continuous. Mr Butcher explained that it was a tight finish, his horse was responding, and he had got carried away. He accepted it was too much and said he had got it wrong.

Decision

As Mr Butcher has admitted the breach, it is found to be proved.

Submissions for penalty

Mr Mulcay stated that Mr Butcher had a clear record under this Rule. He submitted a $200 fine was appropriate. Mr Butcher did not disagree.

Reasons for penalty

Mr Butcher has admitted using his whip with more than a wrist flicking motion over the last 100 metres of race 1. The starting point in the Penalty Guidelines for a first breach is a fine of $200. There is no reason to increase this starting point.

Conclusion

Mr Butcher is fined the sum of $200.
