Auckland TC 16 June 2022 – R1- SOME GIRLS DON’T

Following the running of the RAY GAVIN HAPPY 80th BIRTHDAY MOBILE PACE an Information Instigating a Protest was lodged by Senior Stipendiary Steward Mr Steve Mulcay against the 4th placing of SOME GIRLS DON’T on the grounds that it broke short of the finish line and was Lapped On by BROOKIES JAFFA which finished 5th.

Rule 870(5) provides: Notwithstanding the provisions of sub-rule (4) hereof any horse which is not in the correct gait when its nose reaches the finishing line and which is lapped on by any other horse or horses in the correct gait shall be placed by the Adjudicative Committee behind such horse or horses provided that where such first mentioned horse is not in its gait as a result of interference to such horse or its driver, then (subject to Rule 869(A) such relegation of the horse shall be at the discretion of the Adjudicative Committee.

Mr Butcher the Driver of SOME GIRLS DON’T advised the Adjudicative Committee that he did not contest the Protest.

Mr Mulcay demonstrated the incident by use of the race films. He showed where SOME GIRLS DON’T broke short of the line and continued in a break until the finishing line. He also showed where BROOKIES JAFFA finished on the outside and it resulted in SOME GIRLS DON’T being lapped on.

DECISION:

The Protest is not contested and is therefore upheld.

SOME GIRS DON’T is relegated from 4th to 5th place and BROOKIES JAFFA is promoted from 5th to 4th place.

The amended placings are therefore:

third (5)      I’LLAVABUBBLES
fourth(8)     BROOKIES JAFFA
fifth (3)       SOME GIRLS DON’T

It is ordered that dividends and stakes be paid in accordance with the amended placings.
