EVIDENCE:

Following the running of Race 1, Chief Stipendiary Steward Mr Nigel McIntyre presented an Information alleging a breach of Rule 865(2) by Trainer Mr Bruce Negus.

Mr Negus wasn’t attending the race meeting and was represented at the hearing by Junior Driver Miss Mia Holbrough, who confirmed the breach was admitted.

Mr McIntyre said these breaches are usually dealt with through the MIN regime, however this is the third breach of notifiable gear by Mr Negus and accordingly, an Information was instigated.

DECISION:

As the charge was admitted, it was deemed proved.

SUBMISSIONS FOR PENALTY:

Mr McIntyre stated Mr Negus’ first breach was at Ashburton on 22 December 2024, followed by Westport on 7 March 2025, both incurring a $100 fine.

Mr McIntyre said this breach, Mr Negus’ third, requires an uplift, which the Stewards believe should be $50.

Miss Holbrough made no submissions.

REASONS FOR PENALTY:

The Adjudicative Committee’s research revealed identical cases to Mr Negus, which resulted in a $150 fine imposed. It could not find any factors to depart from these previous similar cases.

CONCLUSION:

Trainer Mr Bruce Negus is fined $150.
