Penalty: Junior Driver Anj Mugford is fined $100

Evidence:

Following the running of Race 5, RIB Steward Mr Paul Williams presented an Information alleging a breach of Rule 869(7A) by Junior Driver Ms Anj Mugford.

Ms Mugford stated she was conversant with the Rule, understood the charge, and admitted the breach. Ms Mugford was comfortable appearing at the hearing without assistance from a Senior Driver.

Mr Williams played the video of the final pylon being struck by RUTHLESSS LIZZIE which was undisputed by all parties.

Decision:

Ms Mugford having admitted the breach, the charge was deemed to be proved.

Submissions on Penalty:

Mr Williams said Ms Mugford was warned in relation to the Rule, 3 drives ago at Banks Peninsula. He said this Rule is soon to be included into the MIN regime and the normal fine is $100.

Ms Mugford was agreeable to Mr Williams’ submission.

Reasons for Penalty:

The Adjudicative Committee was satisfied the pylon was struck and that a $100 fine is an appropriate penalty.

Conclusion:

Junior Driver Ms Anj Mugford is fined $100.
