Penalty: Rider Krishna Mudhoo suspended for four days.

Summary of facts

Mr Davidson alleged that Mr Mudhoo in Race 1, permitted his mount, LA SUPERBA, to shift inwards near the 1300 metre mark when not sufficiently clear of, Mr Chowdhoory’s mount, MADAME GISELLE, which as a result was checked.

Mr Davidson, with the assistance of Mr Oatham, demonstrated on the films that Mr Mudhoo was racing outside of Mr Chowdhoory, Mr Mudhoo was moving forward to cross Mr Chowdhoory, however, when doing so, he was not quite clear of Mr Chowdhoory. As a result, Mr Chowdhoory  was checked and had to take a hold of his mount.

Mr Mudhoo said he thought he was clear of Mr Chowdhoory but after viewing the race films he clearly was not.

Decision

As Mr Mudhoo has admitted the breach, it is proved.

Submissions as to penalty

Mr Davidson said the breach was very low range. Mr Davidson said Mr Mudhoo has had 354 rides this season and is a busy Rider. He produced Mr Mudhoo’s record which showed three relevant prior breaches of the Careless Riding Rule:

17 March 2022 at Ashburton where he received a 4 day suspension.

16 June 2022 at Riccarton where he received a 6 day suspension.

10 August 2022 at Riccarton where he received a 5 day suspension.

Mr Davidson, in reference to the Penalty Guide, sought a starting point of 5 days with credit for Mr Mudhoo’s acceptance of the breach. Mr Davidson also submitted that Mr Mudhoo’s mount was over racing and was taking longer to come back to him.

Mr Mudhoo sought a deferment of any suspension that the Adjudicative Committee was to impose until after the Riccarton meeting on 5 November 2022.

Reasons for penalty

The breach was low range. The starting point adopted is 5 national days. The Adjudicative Committee agrees that Mr Mudhoo’s record can be characterised as neutral. Credit is given for his admission of the breach which results in an end suspension of 4 days.

Conclusion

Mr Mudhoo’s licence is suspended for 4 National days. This is from the end of racing on 5 November up to and including 11 November 2022.
