Penalty: Class A Trainer, Terri Rae, is fined $150
BACKGROUND:
Licensed Class A Trainer, Terri Rae, was charged with a breach of Rule 616(2) in that she presented SOUTH OF HOUSTON, trained by her, to race in Race 7, Agraforum Growing Innovation Handicap, “to race in side winkers that weren’t notified”.
Ms Rae had signed the Information “I do admit a breach of the rule” and “I do not wish to be present at the hearing of the Information”.
Rule 616 provides:
(2) A Trainer shall not start or attempt to start a horse in a Race in an item or items of Notifiable Gear unless permission has been obtained from a Stipendiary Steward before the horse is accepted or is deemed to be accepted for that Race.
EVIDENCE:
Stipendiary Steward, Veronica Algar, said that SOUTH OF HOUSTON, trained by Ms Rae, had been presented for Race 7 to race in side winkers, which had not been notified.
DECISION:
The charge having been admitted, it is deemed proved.
PENALTY SUBMISSIONS:
Ms Algar said that this was the third breach by Ms Rae in the 120-day period. The first was on 1 December 2024, when she was fined $100 under the Minor Infringement Scheme, and the second was on 21 January 2025 (at that time a third breach), when she was fined $150. As a third breach, the present breach was, therefore, outside the scope of the MIN Scheme and an Information has been filed. Ms Algar submitted that a fine of $150 would be appropriate, consistent with the penalty for the breach on 21 January, also a third breach.
REASONS FOR PENALTY:
The Minor Infringement Schedule requires that an Information be filed if the person alleged to have committed the breach has already committed two or more breaches of the same Rule in the preceding 120 days. This, Ms Rae’s third breach in that period.
The penalty/fine for a “notifiable gear” breach is $100 for a second breach. An uplift is appropriate for this, a third breach. An uplift of $50 is appropriate, consistent with the penalty for the breach on 21 January.
CONCLUSION:
Class A Trainer, Terri Rae, is fined the sum of $150.
