Evidence:

Following the running of Race 3, an Information was presented by Stipendiary Steward Mr Paul Williams alleging a breach of Rule  869(7A)(a) by Junior Driver Mr Carter Dalgety.

Mr Dalgety stated he was conversant with the Rule and the charge, comfortable without the assistance of a Senior Driver, and confirmed his admittance of the breach.

Mr Williams showed the video replay of the incident identifying Mr Dalgety trailing the leader entering the home straight. He pointed to Mr Dalgety angle into the passing lane and strike the last pylon with his near side sulky wheel. Mr Williams said Mr Dalgety had not gone inside the pylon and therefore no other issues are in play.

Mr Dalgety had nothing to add.

Decision:

As the charge was admitted, it was deemed proved.

Penalty Submissions:

Mr Williams stated this breach of the Rules will soon be included in the new “MIN” regime and said past breaches of the Rule were dealt with by way of a $100 fine which the Adjudicative Committee endorsed as the appropriate Penalty in this case.

Conclusion:

Mr Dalgety is fined $100.
