Penalty: Apprentice Jockey Callum Jones is fined $400

Evidence:

Following the running of Race 2 the “Tauranga Hardware Plumbing 3YO”, Mr Williamson presented an Information charging Mr C Jones, Apprentice Rider with a breach of Rule 638(3)(g)(i) in that he struck his mount “DIGGER” 6 times with the whip prior to the 100 metre mark.

Mr Williamson demonstrated from the race film the extent of the breach of the Rule by Mr Jones.  Upon entering the home straight “DIGGER” was struck with the whip by Mr Jones 6 times prior to the 150 metre point.

Decision:

Mr Jones, assisted by Mr Harris, admitted the breach and it is therefore deemed proved.

Submissions for Penalty:

Mr Jones has had 2 breaches of this Whip Rule on 18 May and 22 June 2022.

Mr Harris advised that Mr Jones had 6-7 months away from riding before recommencing and would have some education in his obligations and the Revised Guideline from 1 March 2022.

Reasons for Penalty:

Mr Jones’ mount finished 3rd and his riding fee percentage amounted to $135 – for which he was required to share with his employer.  The Penalty “Guidelines” set out a starting point which for a 3rd offence is a $500 fine.  Mr Jones has just recommenced riding, and he has had 2 recent fines of $250 each; the Adjudicative Committee advised him that any further breach would without doubt lead to a fine of at least $500 (or more) plus suspension for (at least) 2 national riding days.  In this case, from the starting guide of $500 the fine is adjusted to $400 so as to remove any bonus achieved by the result and which will reflect any punitive factor.  The recent (this year) inexperience of this Apprentice justified a discount from the $500 initial guide, in the Judgment of the Adjudicative Committee.  But Mr Jones has been left in no doubt as to the severity of any penalty for another breach.

Conclusion:

Mr Jones is fined $400.
