Summary of Facts
Following the running of Race 6, the Respondent, Ms M Sanson admitted a charge of careless riding which was filed pursuant to Rule 638(1)(d). The Information alleged that the Respondent:
“allowed her mount SPIRIT OF BEXLEY to shift outward in the home straight when not clear of FLOWRE OF WANAKAÂ (Ms F Lazet) who was checked”.
The Respondent confirmed that she understood the Rule and admitted the breach. This was confirmed by Ms Clapperton.
Rule 638(1)(d) provides: A rider shall not ride a horse in a manner which the Adjudicative Committee considers to be careless.
Evidence
Using available film Stewards demonstrated the incident and identified the horses and riders concerned. Approaching the turn SPIRIT OF BEXLEY had been travelling closer to the fence than the rest of the field who were wider on the track seeking better going. On straightening Ms Sanson followed WATTABREEZE across the track seeking better footing. When doing so she was insufficiently clear of FLOWER OF WANAKA who was checked.
When questioned Ms Sanson confirmed she was seeking to follow WATTABREEZE across but miscalculated how Ms Lazet’s horse was travelling. It was an error of judgement. Ms Clapperton concurred with this comment.
Reason for Decision
As Ms Sanson admitted the breach the Adjudicative Committee found the breach proved.
Submission for Penalty
Mr Coppins produced the Respondent’s record where it was noted that a suspension of 4 National Riding days was imposed for a low range careless riding breach on 20 November 2021 (Rangitikei RC). Ms Sanson has had 67 rides this current season. Stewards assessed the level of carelessness to be in the low range.
Ms Sanson sought deferment of any penalty to satisfy riding commitments at Matamata on Friday 13th May .
Reason for Penalty
After consideration of the incident and all submissions the committee determined Ms Sanson’s carelessness to be low range. Although her mount did move a number of horse widths, she is entitled to do if sufficiently clear of other runners. In this instance she was not. Based upon NZTR Revised Penalty Guidelines for Whip Rule and Careless Riding Rule Breaches – effective 1st March 2022 a starting point (low range) of 5 national days suspension was adopted. There are no aggravating factors influencing penalty whilst mitigating same was her ready admission. A one day reduction in penalty was deemed appropriate.
Conclusion
Ms Sanson’s Licence to ride is suspended for 4 national riding days commencing after the close of racing on 13th May 2022 up to and including 19th May 2022.
