FACTS:
Mr Elliot admitted a breach of Rule 330(3)(c) in that he failed to make the weight for “LEADERBOARD” Race 4 and “LES CRAYERES” Race 5 (1kg overweight).
Mr Elliot confirmed that he admitted the breach and that he understood the Rule.
Mr Elliot told the Adjudicative Committee that he had tried very hard to make the weight and even had a sauna on race morning but that he could not shed the weight.
DECISION:
As the charge was admitted it was deemed proved.
PENALTY SUBMISSIONS:
Mr Oatham said that the matter would normally have been dealt with under the minor infringement penalties, but as one race was Listed and one a Group 3 race, he believed it needed to be dealt with by the Adjudicative Committee.
He added that the overweight had inconvenienced two lots of connections.
Mr Elliot said that his body would just not sweat on race morning when in the sauna.
REASONS FOR PENALTY:
Taking all submissions into consideration the Adjudicative Committee determined that a fine of $300 was appropriate.
CONCLUSION:
Mr R Elliot was fined $300.
