SUMMARY OF FACTS
Mr Abernethy admitted a charge of using his whip with more than a wrist and flicking motion in the home straight. Mr Abernethy was the Driver of RACEY RACH.
Mr Abernethy said that he understood the Rule, the charge and confirmed that he admitted the breach.
Mr Mulcay showed relevant film replays and said that over the final 3 to 4 strides, Mr Abernethy used his whip in more than a wrist flicking motion.
Mr Abernethy agreed and said that that was why he admitted the breach.
DECISION
As the charge was admitted it was found proved.
PENALTY SUBMISSIONS
Mr Mulcay said that Mr Abernethy had a very good record and then referred to the Penalty Guide.
Mr Abernethy said that he had a good record for 2 years.
REASONS FOR PENALTY
Taking into account the very good record, Penalty Guide and admission of the breach a fine of $200 was deemed suitable.
CONCLUSION
Mr Jay Abernethy was fined $200.
