SUMMARY OF FACTS:
After the running of Race 5, the NZB Insurance Pearl Series Race, the Stipendiary Steward presented an Information contending that Mr Bosson committed a breach of Rule 638(3)(g)(i) (the “Whip Rule”) in that he struck his mount “STERNLAND” with the whip 6 times prior to reaching the point 100 metres from the finish.
Mr Bosson admitted the breach.
Mrs Selvakumaran illustrated the breach by referring to the race film. This disclosed that Mr Bosson when leading early in the home straight struck STERNLAND with the whip 6 times before the 100 metre mark. The horse was overtaken late and finished 3rd.
DECISION:
As the breach was admitted, it was deemed proved.
SUBMISSIONS FOR PENALTY:
The Informant advised that Mr Bosson has had 4 previous breaches of the Rule in the last 6 months, mostly in November 2021 up to January 2022, and a period of suspension had to be imposed.
Mr Bosson did not make any penalty submission other than to accept that he had to be suspended.
REASONS FOR PENALTY:
After considering the evidence from all parties, the Adjudicative Committee determined that a suspension would be the appropriate penalty in this case.
CONCLUSION:
Taking the NZTR Penalty Guide as a guide only, a suspension of 5 National Riding Days, and as he has committed engagements over the next 7 days, the suspension shall commence at the conclusion of racing on 23 February 2022 and to end on the conclusion of racing on 3 March 2022.
