SUMMARY:

Following the running of Race 4, Mr Davidson presented an Information charging Ms O Helagi with careless riding, in breach of Rule 638(1)(d), in that “she allowed her mount VERDI’S OPERA to shift inwards when not sufficiently clear of TIME TRAVELLER, which clipped a heal and blundered near the 1800 metre point.

Ms Helagi, supported by Ms Waddell, advised she understood the Rule and admitted the breach.

Mr Laking demonstrated the film of the incident. As the field came to the bend out of the home straight at the 1800 metre mark, Ms Helagi on VERDI’S OPERA, came forward on the outside of TIME TRAVELLER, coming across in front of that horse as they entered the bend. VERDI’S OPERA was just a length clear of TIME TRAVELLER, as Ms Helagi’s mount angled across into the bend, cutting off TIME TRAVELLER, who clipped heals and blundered.

Ms Helagi accepted the Steward’s interpretation of the incident. She said that she had initially looked across, but had continued on and not checked again to ensure that she was sufficiently clear.

DECISION:

As the charge was admitted, it was found to be proven.

SUBMISSIONS FOR PENALTY:

Mr Davidson advised that Ms Helagi had a clear record. While this was her 2nd ride this season, she had 20 rides in total in her career. Mr Davidson noted that the incident could have had severe consequences. In view of Ms Helagi’s clear record and the fact that she was an Amateur Rider, he considered a fine in the vicinity of $200 would be appropriate.

Ms Helagi had no comment to make on penalty.

REASONS FOR PENALTY:

After considering all the circumstances, in particular her clear record and her Amateur Rider status, the Adjudicative Committee determined a fine of $200 was appropriate in this case.

CONCLUSION:

Ms Helagi is fined $200.
