Summary of Facts:
Following the running of Race 8, an Information was lodged by Stipendiary Stewart, Mr M Davidson charging Mr T Moseley with a breach of Rule 638(3)(g)(ii) in that he struck his mount HENLEY with his whip in two consecutive strides.
Mr Moseley was present at the hearing, and admitted the breech and confirmed that he understood the rule.
Rule 638(3)(g)(ii) states that a Rider must not: “strike a horse with a whip in consecutive strides at any stage of the race”.
Submissions:
Mr Davidson asked Stipendiary Stewart, Miss Haley to identify HENLEY over the concluding stages highlighting Mr Moseley striking HENLEY in two of the last three strides prior to the winning post. Henley went on to finish a close second in the race.
Mr Moseley simply said he had reverted back to his old style.
Decision:
Mr Moseley admitted the breach of the Rule and it is therefore deemed proved.
Submission for Penalty:
Mr Davidson advised the Committee that Mr T Moseley had had one breach of the Rule which occurred at the Canterbury meeting on 6 July 2021, where Mr Moseley received a fine of $300.
Mr Davidson stated that Mr Moseley was an extremely busy Senior Jockey in the South Island and that he had a very good record under this Rule.
Mr Davidson submitted that where there had been breaches of the Rules in any category a fine of 50% of the Rider’s share of the stake money was required. Or in this instance a fine of $300 was appropriate.
Mr Moseley submitted that his record was very good and that he simply had been trying really hard and had made an error of judgement in this instance.
Reason for Penalty:
The Committee accepted the recommendation of Mr Davidson taking into account Mr Moseley’s very good record and his very busy riding schedule.
Conclusions:
Mr Moseley was fined the sum of $300 and reminded of his professional obligations under this Rule. He is a well respected Senior Jockey and the expectation is that he should be setting an example.
