Penalty: Andrew Scott, on behalf of Trainers L O’Sullivan and A Scott is fined $100.

EVIDENCE:

Prior to the running of Race 6, the Listed ($70k) Te Akau Gingernuts Salver, Stipendiary Steward Mr W Robinson identified that Mr Scott, the Co-Trainer of TUSCAN HOLIDAY, presented his horse with the incorrect saddle cloth.

Mr Scott admitted the breach and endorsed the Information “I do not wish to be present at the hearing”.

Mr Williamson advised the Adjudicative Committee that the O’Sullivan and Scott Training Partnership had two runners entered in the race, OZARK (No. 10) and TUSCAN HOLIDAY (No. 11).  He said that when TUSCAN HOLIDAY was presented at ‘plate inspection’ it was identified that it had saddle cloth number 10 rather than number 11.  The error was corrected prior to TUSCAN HOLIDAY entering the Parade Ring. There were no consequences to any other party as a result of the error.

REASON FOR DECISION:

The charge is admitted and therefore deemed proved.

SUBMISSION FOR PENALTY:

Mr Williamson submitted a fine of $50 would be appropriate, with a small uplift applied due to the status of the race.

REASON FOR PENALTY:

This is the Training Partnership’s first breach of the Rule.  The Penalty Guide provides for a $50 fine.  However, this breach occurred in a Black Type, (Listed Race) with a stake of $70,000.  On that basis, pursuant to Rule 920, a $50 uplift is applied.

CONCLUSIONS:

Accordingly, Mr Scott, on behalf of Trainers L O’Sullivan and A Scott, is fined $100.
