EVIDENCE:
Following the running of Race 7, the Respondent Mr Darren Danis admitted a charge alleging excessive whip use prior to the 100metres..
Rule 638(3((g)(i) provides that in a Flat Race a Rider must not:
(i) strike a horse with a whip more than 5 times prior to the 100-metre mark (other than in a slapping motion down the shoulder with the hand remaining on the reins);
Using the available race films Senior Stipendiary Steward Mr Williamson demonstrated that the Respondent struck his mount 6 times from the straight entrance to the 100-metre mark. The horse was struck in circumstances where it was not likely to fill a placing. The horse was unplaced.
When asked, Mr Danis did not offer comment.
DECISION:
As the Respondent admitted the breach the Adjudicative Committee finds the breach proved (Rule 915(1)(d) refers).
SUBMISSIONS FOR PENALTY:
Mr Jones produced the Respondent’s record in respect of whip breach. Mr Danis has one previous breach within the last 6 months being 26 December 2021 at Auckland under the same Rule. As a first offence Mr Danis was fined $250.
Recommended was a fine commensurate with the NZTR Revised Penalty Guideline for excessive whip use (as at 1 September 2021).
The Respondent did not offer submission in respect of penalty.
REASONS FOR PENALTY:
The Penalty Guide starting point for a breach of this nature is as follows:
2nd offence starting point Greater of $500 or 50% of jockey share of stake.
After considering the film evidence, the submissions and having regard for the number of and frequency of strikes along with the force used the Adjudicative Committee determined there are no compelling reasons to depart from the starting point set out in the Penalty Guide. On that basis the Respondent is fined $500.
CONCUSION:
The Respondent Mr Danis is fined $500.
