Auckland TR 1 April 2026 – R8 – Joe Nishizuka

Following on from the running of Race 8, YOURRIDE 2100, Stipendiary Steward Mr Brady Jones filed an Information alleging Apprentice Rider, Joe Nishizuka, breached Rule 638(3)(g)(i) in that he struck his mount ELTON ROCKS eight times prior to the 100 metres. 

Mr Nishizuka admitted the breach and was assisted at the hearing by Rider Mentor, Noel Harris. 

Using the available race films of the concluding stages of the race, the Stewards identified ELTON ROCKS.  It was pointed out that shortly after entering the final straight, Mr Nishizuka struck his mount 8 times prior to the 100m mark and twice within the 100m – ten in total. 

His mount went on to win the race.  

Mr Nishizuka agreed with the number of strikes and had nothing further to add.  Mr Harris submitted it was clear from the video, there was no strength in the strikes. 

Decision:

As the charge was admitted, it was deemed proved.

Submissions for Penalty:

The Stewards advised that Mr Nishizuka had a clear record under this Rule.  It was submitted that the fact his mount had won the race, could be regarded as an aggravating factor:  

The Penalty Guide starting point is a fine of $500 for 3 additional strikes. 

Mr Nishizuka had 122 rides in the previous 12 months due to an injury.  In the last 3 years of riding, he had completed approximately 600 rides.  He has a good record.

Reasons for Penalty:

After considering the film evidence, the submissions and having due regard to the number of strikes and lack of force applied, the Adjudicative Committee determined it was appropriate to give a credit for a clear record and for the early admission of the breach. 

Given the starting point is $500, a reduction is applied of $100.  The Adjudicative Committee determined it was unnecessary to apply an uplift due to his mount winning the race.

Conclusion:

Mr Nishizuka is fined $400.
