Evidence
Following the running of Race 3, the Respondent Mr J Riddell, admitted a charge alleging that he struck his mount HARLAN COUNTY 8 times prior to the 100 metres.
Rule 638(3)(g)(i) provides that in a Flat Race a Rider must not:
Strike a horse with the whip more than five times prior to the 100-metre mark (other than in a slapping motion down the shoulder with the whip hand remaining on the reins).
Using the available race films, Ms K Jillings demonstrated that Mr Riddell struck his mount eight times prior to the 100-metre mark, followed by a further two strikes after that point. He ran 3rd in the race.
By way of explanation, Mr Riddell stated that he had simply miscounted. He said it was an honest mistake and one he rarely makes.
Decision
As Mr Riddell admitted the breach, the Adjudicative Committee finds the breach proved.
Submissions on Penalty
Ms Selvakumaran advised that Mr Riddell has a clear record under this Rule, covering the past 12 months and 316 rides. The Stewards submitted that the penalty should be consistent with the NZTR Revised Penalty Guide for excessive whip use.
Reasons for Penalty
Under the Penalty Guide, the starting point for a first‑time breach involving three strikes over the permitted number is a fine of $500. The purpose of the Penalty Guide is to promote consistency and fairness across similar breaches, ensuring Riders are treated equally. While Mr Riddell’s clear 12 month record is acknowledged, the nature of Whip Rules means penalties generally follow the prescribed scale to maintain uniformity. There were no particular factors warranting a departure from the standard approach and therefore, the starting point of $500 was considered fair and proportionate in this case.
Conclusion
Accordingly, the Respondent, Mr J Riddell, is fined $500.
