SUMMARY OF FACTS:
Following Race 11 Ms T Thornton admitted a breach of Rule 638(3)(g)(i) in that she struck her mount “MACS” 7 times with her whip prior to the 100m (the limit being 5).
Ms Thornton signed the Information that she did not wish to be present at the hearing of this Information.
EVIDENCE:
Film replays were shown to the Adjudicative Committee, which confirmed that Ms Thornton had struck her mount 7 times prior to reaching the 100m.
Mr Oatham said that when questioning Ms Thornton prior to the hearing, she said that her whip had become caught in the breast plate. He said that the Stewards could not see where that had happened.
REASON FOR DECISION:
As the charge was admitted and the breach confirmed by film replays, it was found proved.
SUBMISSION FOR PENALTY:
Mr Oatham produced Ms Thornton’s record which showed five whip breaches within the last 6 months; the latest being on 10 December which resulted in a 5-Riding Day suspension and a fine of $420 being imposed.
Mr Oatham referred to the Penalty Guide starting points.
REASON FOR PENALTY:
Ms Thornton has an unenviable record; having now had six breaches of the Whip Rule within 6 months.
Subsequent to considering all matters in relation to penalty, the Adjudicative Committee determined that a 7-Riding Day suspension was an appropriate penalty.
CONCLUSIONS:
Ms T Thornton’s Jockey’s Licence was suspended from 19 December through to the close of racing on 31 December 2021.
