EVIDENCE:

Following the running of R2, the “JASE SCAFFOLDING MOBILE PACE”, Mr Mulcay presented an Information charging Mr Hay with careless driving, in breach of Rule 869(3)(b).

It was alleged that when entering the first turn out of the home straight, Mr Hay allowed his horse to shift inwards when not sufficiently clear of WHO’S YOUR DRAGON, driven by Ms K Coppins, which resulted in that horse being checked and contacted the track markers.

Mr Hay admitted the breach of the Rule.

The race film as shown in evidence by Ms Jillings, depicted that about 200 metres after the start, the field entered the first bend, GENUINE IMITATION was racing wide and going forward.  WHO’S YOUR DRAGON was racing near the rail and holding its position.  Mr Hay directed his horse inwards into the line of Ms Coppins’ horse when not sufficiently clear.  As a consequence, Ms Coppins was tightened and had to check her horse and lost its position and  hit a marker on the inside of the track.

Mr Hay accepted he mistakenly thought he was clear, his horse was green and inexperienced, and he tried to correct the movement, but the “decision was too little and too late”.

DECISION:

As the charge was admitted, it was deemed proved.

SUBMISSIONS FOR PENALTY:

Mr Mulcay advised that Mr Hay had a clear record, with no breaches, although had one warning in November 2025.  The breach was in the low range and had “minimal effects” apart from Ms Coppins losing the position to which she was entitled.

REASONS FOR PENALTY:

The Penalty Guide refers to either a 2 days suspension or fine of $350.  Mr Hay said he wished to keep driving in the Central Districts.  Because of his very good record, and the relatively minor effects on Ms Coppins’ horse, which the Adjudicative Committee considers to be mitigating, and warrants some concession, a fine of $250 was imposed.

CONCLUSION:

Mr Hay is fined $250.
