Background:

Following the running of Race 7, the Group 2, Hallmark Stud Eight Carat Classic’, an Information was lodged alleging a breach of Rule 638(3)(g)(ii). The Information read as follows:

‘in that he used his whip in two consecutive strides over the concluding stages’.

Rule 638(3)(g)(ii) provides .. (g) a Rider must not (ii) strike a horse with a whip in consecutive strides at any stage of the race;

Prior to commencement of the hearing, Mr Dee confirmed that he admitted the breach.

Evidence:

Using available film, Stewards identified the incident.  The horse was running the race out strongly toward the outside of the track, with the Respondent seen to strike his mount in consecutive strides within the last 100 metres. The Respondent did not contend Steward interpretation.

Decision:

As the charge was admitted, it was deemed proved.

Submissions as to Penalty:

Stewards advised the Respondent’s record. Mr Dee is a Victorian based Jockey. His record was advised as being clear, as it relates to any breach of this Rule. The Penalty Guide provides for a warning in circumstance of using the whip in 2 consecutive strides, 1st offence. However, given the status of the Race, the Information was filed. Warnings are not provided for in this instance, with the Penalty Guide providing for starting point set at 50% of the Jockey’s share of the stake earned. The horse finished 4th in the event, earning a stake of $13,500.

Reasons for Penalty:

Film identifies the breach. Based upon the stake earned, 50% of the Jockey’s share is calculated at $337.50. On balance, a fined set at $300 was determined to be the appropriate penalty.

Conclusion:

Jockey Mr Mick Dee is fined a sum of $300.
