Penalty: Class A Rider Rohan Mudhoo is suspended for 4 days
Mr Davidson alleged that Mr Mudhoo rode carelessly in Race 9, in that he allowed his mount GENERATION JOY to shift outwards, dictating ZADANE onto PEEKAY, which was crowded and checked near the 250 metres.
Mr Munro demonstrated on the videos that Mr Mudhoo, when racing on the rail, shifted out, looking for a run. In so doing, he dictated ZADANE out into the line of PEEKAY, which was crowded and checked.
Mr Mudhoo said the horse in front was getting tired and he had shifted out to look for a run. He knew he had shifted out and emphasised there was no contact with ZADANE. He was aware the horse was there and was intending to shift out nice and easy. He also believed that ZADANE had shifted further than it should have.
Decision
As Mr Mudhoo has admitted the breach, it is found to be proved.
Submissions as to Penalty
Mr Davidson produced the Respondent’s record, which was excellent with no breaches of this Rule in the past 12 months. Mr Davidson described the breach as low-range.
Mr Mudhoo stated he accepted Mr Davidson’s submissions and wished the suspension to start after racing on the 14th of December.
Reasons for Penalty
Mr Mudhoo has shifted ground outwards when not his length and another clear. ZADANE was dictated onto PEEKAY, which was crowded and checked. The breach is correctly categorised as a low-range breach. From a 5-day starting point, there is a one-day reduction for admission of the breach and Mr Mudhoo’s excellent record.
Conclusion
Mr Mudhoo is suspended from the end of racing on the 14th of December, up to and including the 21st of December 2025. This is 4 national riding days.
