Summary of Facts:
Following the running of Race 2, an Information was filed by Senior Stipendiary Steward Mr Mulcay alleging the Respondent Mr Tim Hall breached Rule 869(4)(b)(c) in that as the Driver of CRAZY, he shifted his runner outwards at the 1100 metres when not entitled to do so, forcing YUROK (T Macfarlane) wider on the track.
The ‘Pushout Rule’ (r689) provides that:
(6) Subject to sub-rule (4) hereof:
(a) Drivers are permitted to move ground inwards or outwards at any stage of the race to improve their racing position; (b) a horse making a forward movement during any race shall not be forced to race wider on the track; (c) a horse during a race shall not move ground outwards once the nose of the wider runner coming forward is in line with or past its sulky wheel and until the wider runner going forward is fully past.
(7) Sub-rule (6)(b) and (c) of this Rule shall apply until 1000 metres from the finish of the race. From this point all Drivers shall be expected to make moves, with safety, to ensure the horse obtains the best possible place in the field.
Mr Hall was present at the hearing. He admitted the breach and endorsed the Information accordingly.
Deputy Chief Stipendiary Steward Mr Wallis used the available race films to prove the breach. He showed CRAZY driven by Mr Hall, racing five back on the fence near the rear of the field approaching the 1200 metre mark. YUROK was also back in the field slightly behind, and on the outer of CRAZY. Mr Wallis pointed out that near the 1100 metres, Mr Hall shifted outward and in doing so, pushed YUROK from a one out to a three wide position.
Mr Hall said that he agreed with the Steward’s interpretation of the incident and added “I timed my run too early.”
Decision:
The charge is admitted by the Respondent and is therefore considered proved.
Submissions for Penalty:
Mr Mulcay said that Mr Hall has a clear record under the ‘Push-Out’ Rule.
He submitted that the Penalty Guide provides for a $200 fine for a first breach of this Rule, and there are no aggravating factors associated with the breach.
Mr Hall made no submissions as to penalty.
Reasons for Penalty:
The Penalty Guide establishes a $200 fine as the starting point. The impact on the affected runner YUROK, was minimal. There are no aggravating factors to consider. Therefore, after evaluating the evidence and submissions, the Adjudicative Committee imposed a $200 fine.
Conclusion:
The Respondent Mr Hall is fined $200.
