Penalty: Rider Corentin Berge is fined a sum of $300

Background:

Following the running of Race 1, the ‘Ixom Maiden’, an Information was lodged alleging a breach of Rule 638(3)(f)(ii). Details are as follows:

‘in that he used his whip with an action which raised his arm above shoulder height on two occasions when riding QUASI’’.

Rule 638(3)(f)(ii) provides:

(f) A Rider must not use his or her whip:

(ii) using an action that raises the Rider’s arm above shoulder height.

The Respondent confirmed to the Adjudicative Committee that he understood and admitted the breach.

Evidence:

Using available film, Stewards identified the incident. On the home turn, QUASI was positioned away from the fence. Mr Berge is seen to strike his mount, with the action commencing from above shoulder height. This action is repeated at the 200 metre mark. Mr Berge was generally in agreeance with Steward interpretation. There was discussion as to whether the second strike was ‘marginal’, in respect of it’s compliance.

Decision:

As the Respondent admitted the breach, the Adjudicative Committee found the breach proved.

Submissions for Penalty:

The Adjudicative Committee was referred to the current Penalty Guide. This is the Respondent’s second breach of the Rule. A fine of $250 was imposed at the Racing Tauranga meeting on 1 November 2025 (two strikes). Mr Berge has only recently relocated to New Zealand and has some 63 race day rides. Mr Berge did comment that he is trying to adapt to the requirements of the Whip Rules.

Reasons for Penalty:

Available film identifies the alleged breach.  The current Penalty Guide provides for a starting point of a $250 fine for a first breach under this particular Rule. Recognizing circumstance, a fine of $300 is deemed the appropriate sanction.

Conclusion:

Mr Berge is fined a sum of $300.
