EVIDENCE:
Following the running of Race 2, Chief Stipendiary Steward Mr Nigel McIntyre presented an Information alleging a breach of Rule 869(4)(6)(b)(c) by Driver Tim Williams.
Mr Williams stated he was conversant with the Rule and the Charge and confirmed he admitted the breach.
Mr McIntyre played the video at the 2200m, to show Mr Williams (HALEY JACCKA) shifting his horse away from the pylons and into the racing line of DENY EVERYTHING (S Ottley), forcing it wider on the track.
Mr Williams chose not to make comment.
DECISION:
The Respondent having admitted the breach, it was deemed to be proved.
SUBMISSIONS FOR PENALTY:
Mr McIntyre said Mr Williams has a clear record under the Rule and has driven 586 times this season. He said the usual fine for a breach of this Rule is recommended by Stewards.
Mr Williams said he would appreciate any discount on this figure.
REASONS FOR PENALTY:
The Penalty Guidelines provide a $200 fine for a first breach of the Rule and the Adjudicative Committee can find no factors to depart from the Guidelines on this occasion.
CONCLUSION:
Driver Tim Williams is fined $200.
