Penalty: Class A Rider Choon Kin Kwo is suspended for 6 days

Mr Davidson alleged that in Race 3, Mr Kwo rode carelessly in that he allowed his mount DRACARYS to shift out checking CLANCY (Ms Comignaghi), which also contacted SNOW BRAINER near the 50 metres.

Miss Haley demonstrated on the videos that Mr Kwo shifted outwards near the 50 metres severely checking and coming into contact with Ms Comignaghi who in turn contacted Mr Cooper (SNOW BRAINER). This interference had resulted in a successful protest by SNOW BRAINER against DRACARYS.

Mr Kwo said DRACARYS was hanging out the entire race. At the 50 metres, he was still ahead of the other horses, and DRACARYS had wanted to run out further. He had struck it once at the top of the straight and had given it one more at the 50 metres.

Mr Davidson emphasised that Mr Kwo’s obligation was to straighten his mount.

Decision

As the Respondent has admitted the breach, it is found to be proved.

Submissions as to Penalty

Mr Davidson stated that the Stewards believed the breach was mid-range. There had been a relegation. He produced Mr Kwo’s record, which was clear under this Rule for the past 12 months. He said Mr Kwo had been injured and had had 47 rides in this time.

Mr Kwo accepted Mr Davidson’s submission and asked for a deferment until after racing at Gore on 23 October.

Reasons for Penalty

The breach is mid-range. Mr Kwo has shifted out quite abruptly at the 50 metres and at the same time, he has struck his mount with the whip, rather than endeavouring to straighten it. Mr Kwo’s actions have resulted in his horse being relegated. From a 7-day starting point, a one-day credit is given for record and admission of the breach.

Conclusion

Mr Kwo is suspended from end of riding on 23 October, up to and including 31 October 2025. This is 6 National Days and includes 2 South Island meetings.
