Background:
Following the running of Race 10, an Information was lodged requesting a ruling pursuant to Rule 648(3). Details are as follows:
‘in that Tayla Mitchell (Delorean) weighed in .6kgs under’.
Rule 648(3) provides that:
If, on being weighed in, a Rider cannot draw the proper weight (meaning thereby the weight allotted by the Handicapper for his horse to carry and adjusted only by any re-handicap, by having been declared overweight, by penalty or by authorised allowance) the Clerk of the Scales shall allow such rider 0.5 kg and if the allowance is not sufficient to enable the proper weight to be drawn then subject to sub-Rule (4) of this Rule then in addition to any other penalty which may be imposed the horse shall be disqualified for the Race.
Additionally, Rule 649(3) provides that:
A Rider must not weigh-in at a weight that exceeds or is less than the proper weight as is defined in and with the allowance permitted by Rule 648(3).
Stewards sought disqualification of DELOREAN. They also sought forfeiture of Ms Mitchell’s riding fee (Rule 357(2) refers).
Ms Mitchell acknowledged the Information and confirmed her understanding of same. Ms Mitchell was assisted in the hearing by Mr Noel Harris.
Evidence:
The Clerk of Scales return was tabled. DELOREAN had a carded weight of 57kg. After allowance for gear along with apprentice claim, it was to carry 57kg. Ms Mitchell weighed out at 57.2kg. DELOREAN finished 6th in the event, with $370 allocated as prize money for that placing. Weight on returning to scale was 56.4kg. Ms Mitchell was at a loss as to how this situation eventuated.
Decision:
The Adjudicative Committee was satisfied that events represented a breach, with the weight upon the return to scale, being beyond that tolerance afforded within the Rule ie: .5kg. The Rule is worded as such, as to require disqualification of the horse.
Conclusion:
Pursuant to Rule 648(3), the Adjudicative Committee determined that DELOREAN be disqualified from Race 10 at Taupo Racing Club meeting on 10 October 2025, in addition to which Ms Mitchell forfeits her riding fee (Rule 357(2).
