SUMMARY OF FACTS:

Following the running of Race 2 Stipendiary Steward Mr Paul Williams presented an Information alleging a breach of Rule 869(4) by Driver Mr Jack Harrington which was admitted. Mr Harrington confirmed to the Committee he admitted the charge and he was conversant with the Rule.

EVIDENCE:

Mr Williams assisted by Mr Renault showed the race replay and identified Mr Harrington (FLY LIKA FALCON) racing 3 wide at approximately 1100 to run. Mr Renault pointed to Mr Harrington cross to the parked position and immediately ease his horse. He said this was done too abruptly and although no horses broke the consequences were, every runner in the 2 wide line received some sort of check.

Mr Harrington stated his horse is very green, is touchy in the mouth, and overreacted upon being eased.

REASON FOR DECISION:

Mr Harrington having admitted the breach the charge was accordingly found proved.

SUBMISSION FOR PENALTY:

Mr Williams said Mr Harrington had a clear record under the Rule.

Mr Williams stated there was a similar breach under this Rule earlier in the month where the Driver was fined $250, which is where the Stewards recommend the appropriate fine should be in this case.

Mr Harrington submitted he would prefer a fine over a suspension and asked the Committee to consider his good record.

REASON FOR PENALTY:

The Penalty Guidelines provide a 6 drive suspension or a $300 fine starting point for a breach of this Rule. The Committee considers a fine is in order for this case.

Mr Harrington has been frank, professional, and admitted the breach for which he receives credit.

CONCLUSION:

Mr Harrington is fined $250.
