EVIDENCE:

Following the running of Race 5, Stipendiary Steward Mrs Rebecca Haley presented an Information alleging a breach of Rule 638(3)(g)(i) by Class A Rider Mr Terry Moseley.

Mr Moseley stated he was conversant with the Rule, the Charge and confirmed he admitted the breach.

The video showed Mr Moseley finishing on the rail and striking his mount 7 times prior to the 100m and a further 4 times until reaching the winning post.

Mr Moseley agreed with the count.

DECISION:

The Respondent having admitted the breach, it was deemed to be proved.

SUBMISSIONS FOR PENALTY:

Mrs Haley said Mr Moseley has a clear record and stated the prescribed penalty for 2 strikes beyond the allowable limit, is a $250 fine.

Mr Moseley made no submissions.

REASONS FOR PENALTY:

The Penalty Guidelines provide a $250 fine for a first offence with 2 additional strikes and there are no factors to alter this figure.

CONCLUSION:

Jockey Terry Moseley is fine $250.
