EVIDENCE:

Following the running of Race 8, Stipendiary Steward Mr Mark Davidson presented an Information alleging a breach of Rule 638(3)(g)(i) by Jockey Mr Vinnie Colgan.

Mr Colgan stated he admitted the breach and he was conversant with the Rule.

Mr Davidson played the final straight video to identify Mr Colgan (STONYBRECK) finishing strongly on the outside of the field. He pointed to Mr Colgan strike his horse 7 times prior to the 100m and then a further 4 times to the winning post.

Mr Colgan agreed with the count and made no further comment.

DECISION:

The Respondent having admitted the breach, the charge was deemed proved.

SUBMISSIONS FOR PENALTY:

Mr Davidson stated Mr Colgan was fined $250 under the Rule on 31 May at Waikato.

Mr Davidson said a second breach within the reset period commands a $500 fine.

Mr Colgan made no submissions.

REASONS FOR PENALTY:

The Penalty Guidelines provide a $500 fine starting point for a second breach of this Rule, and the Adjudicative Committee can find no reasons to depart from the Guidelines on this occasion.

CONCLUSION:

Jockey Mr Vinnie Colgan is fined $500.
