SUMMARY OF FACTS:
Following the running of Race 3, an Information was lodged by Ms V Algar alleging a breach of Rule 638 (1) (d) in that Faye Lazet shifted her mount KAPINOS inwards when not sufficiently clear of STUMPY which was checked passing the 800 metres.
Ms Algar had Mr Goodwin explain the incident using the available video angles. Approaching the end of the back straight Ms Lazet was racing approximately 5 horse widths off the fence but trying to get a position closer to the rail. Mr Goodwin said the three runners to her inside were expecting her to go forward. Ms Lazet looked several times to her inside before moving inwards. Unfortunately she crossed STUMPY when not the required distance clear causing Ms Allpress to check her mount.
Ms Lazet said the incident was a misjudgment on her part, and she only became aware she was not sufficiently clear when she heard Ms Allpress yell out to her.
DECISION
Ms Lazet admitted the breach therefore the charge was deemed proved.
SUBMISSION FOR PENALTY:
Ms Algar said this was the first charge of careless riding for Ms Lazet and described today’s breach as low end. She is apprenticed to Mr M Breslin and seldom troubles the Stewards.
Ms Lazet said she has been riding for about a year and in that time has had 271 rides. She advised of riding commitments through until Waverley on Sunday.
REASON FOR PENALTY:
In setting penalty, the Committee had regard to all submissions. Ms Lazet could be seen looking across prior to moving inwards and simply erred in thinking she was the required distance clear of STUMPY. The requirement for a Rider is to be their own length, plus one other, before crossing another horse. While Ms Lazet confirmed she was aware of the Rules, on this occasion she was only her own horse length clear. Her degree of carelessness sits in the low range. In line with the new Penalty Guidelines the Committee adopted a starting point of 5 days suspension. Taking into account Ms Lazet’s excellent record, and her admission of the breach a discount of 1 day was allowed.
CONCLUSIONS:
Accordingly, Ms Lazet’s License is suspended from the close of racing on Sunday November 14th up to and including racing on Saturday November 20th.
