SUMMARY OF FACTS:
Mr Jones presented an Information following the running of Race 10, the BRENDON AND LYNN BRADLEY BAYLEYS COMMERICAL 1400, alleging that Mr McNab, the Rider of FOUR QUEENS breached Rule 638(3)(g)(ii).
The alleged breach was that Mr McNab struck his mount with the whip on 3 consecutive strides prior to the finish of the race.
Mr McNab admitted the breach of the Rule and said that he did not wish to be present at the hearing of the Information – which was some time after racing finished for the day.
SUBMISSIONS:
Mr Jones demonstrated from the race film that Mr McNab riding FOUR QUEENS was leading the field close to the finishing post, but when fast finishing CORINNE challenged, he struck his mount 3 times in the final 50 metres. FOUR QUEENS was caught by CORINNE and beaten into second place by a narrow margin of a lead.
REASON FOR DECISION:
FOUR QUEENS was a dominant favourite for the race, and whilst it may be understandable that Mr McNab acted so as to do his best to retain his lead, the consecutive strides breached the “Whip” Rule as Mr McNab accepted.
SUBMISSION FOR PENALTY:
Mr McNab has no relevant breach of the Rule in the past 6 months.
REASON FOR PENALTY:
In line with the Penalty Guidelines he is fined $150.
CONCLUSIONS:
Mr McNab is fined $150.
