SUMMARY OF FACTS:
Mr Downs the Rider of FLYING WITHOUT WINGS) in Race 4 (Pakuranga Hunt Landowners Mdn Steeplechase) was charged with striking his mount in three consecutive strides over the concluding stages.
EVIDENCE:
Mr Jones showed film replays and identified where Mr Downs struck his horse three consecutive times.
Mr Downs agreed with Mr Jones.
REASON FOR DECISION:
As the charge was admitted and together with the film evidence, it was deemed proved.
SUBMISSION FOR PENALTY:
Mr Jones said that Mr Downs had one prior breach of the Whip Rule on 10 June 2021 when a fine of $350 was imposed. He added that the Penalty Guideline for 3 consecutive strikes calls for a $150 fine or 50% of the Jockey’s share of the stake, whichever is the greater.
Mr Downs agreed with his record and added that he became a little excited.
REASON FOR PENALTY:
Mr Downs’ mount won the race with prizemoney being $8,400. Mr Downs’ share being approximately $800 with 50% being $400.
CONCLUSIONS:
Mr Downs was fined $400.
