EVIDENCE:

Following the running of Race 8, the Group 3 TAB Mile, Stipendiary Steward Mr Mark Davidson presented an Information alleging a breach of Rule 638(1)(d) by Class A Rider Mr Donavan Mansour.

Mr Mansour stated he understood the Charge, was conversant with the Rule and confirmed he admitted the breach.

Mr Davidson had Chief Stipendiary Steward Mr Oatham, identify Mr Mansour (WESSEX) drawn the outside of the starting gates at 17 in the 1600m race. He pointed to Mr Mansour begin fast and after approximately 200m, shifted inwards when not sufficiently clear, dictating HE’S A DOOZY (J Doyle) inwards, crowding DISS IS DRAMATIC (T Comignaghi), which was checked.

Mr Mansour, after viewing the videos, said he believed TIMES TICKING (A Balloo) had kicked up to the inside of DISS IS DRAMATIC and had made his move look worse than it was.

DECISION:

The Respondent having admitted the breach, the charge was deemed to be proved.

SUBMISSIONS FOR PENALTY:

Mr Davidson said Mr Mansour had 1 previous breach of the Rule within the last 12 months.

October 2024 – 5 days for a low-level breach.

Mr Davidson said Mr Mansour has had approximately 60 rides since resuming race riding. He said this breach is in the low to mid-range, with the race carrying a Group 3 rating.

Mr Mansour made no submissions on Penalty, but asked for a deferment so he could ride this Saturday 16 November 2024.

REASONS FOR PENALTY:

The Penalty Guidelines provide a 6-day suspension for a low to mid-range breach of this Rule.

The Adjudicative Committee views the breach to be in this range, as the video clearly shows DISS IS DRAMATIC losing several lengths in the check.

The Adjudicative Committee is compelled to uplift the starting point for the status of the race, which it sets at 2 days. In consideration of Mr Mansour’s admission and good record, the Adjudicative Committee gives him credit of 1 day.

The Adjudicative Committee, in considering all factors, finds a 7-day suspension to be appropriate in the circumstances of this case.

Deferment was granted pursuant to Rule 1106.

CONCLUSION:

Class A Jockey Mr Donavan Mansour’s Licence to ride in races is suspended from the conclusion of racing on Saturday 16 November 2024, up to and including racing on 27 November 2024.
