Penalty: Apprentice Rider Ciel Butler is suspended for 7 days and fined $150

EVIDENCE:

Following the running of Race 6, Stipendiary Steward Mr Mark Davidson presented an Information alleging a breach of Rule 638(3)(g)(i) by Apprentice Jockey Miss Ciel Butler.

Miss Butler stated she was conversant with the Rule, the Charge, and confirmed she admitted the breach. Miss Butler was supported by Senior Rider Ms Kate Hercock.

Mr Davidson played the relevant videos to identify Miss Butler racing widest on the track entering the home straight and pointed to her strike her mount 8 times prior to the 100m mark.

Miss Butler and Ms Hercock agreed with the count and had nothing to add.

DECISION:

The Respondent having admitted the breach, the Charge was deemed to be proved.

SUBMISSIONS FOR PENALTY:

Mr Davidson said Miss Butler has two previous breaches of the Rule namely:

17 August 2024 at Taranaki, $250 fine.

24 August 2024 at Waikato, 6-day suspension.

He said the Guidelines have a starting point of a 5+day suspension and in addition, a fine at 50% of the Jockey’s share of the stake may be imposed. He said today’s race was at Group 3 level, which the Stewards would expect an uplift in Penalty to apply.

Miss Butler made no submissions on Penalty, but asked to start any preposed suspension after 17 November 2024.

REASONS FOR PENALTY:

The Penalty Guidelines provide a 5+day suspension for 3 additional strikes, third offence.

The status of this race, Group 3 Canterbury Breeders Stakes at $120,000, is an aggravating factor and the Adjudicative Committee considers an uplift of 1 day is warranted.

In addition, Miss Butler is fined 50% of her riding percentage, which equates to $150.

Accordingly, it considers the appropriate Penalty is a 7-day suspension and a $150 fine.

CONCLUSION:

Apprentice Jockey Ciel Butlers’ Licence to ride in races is suspended from the conclusion of racing on 17 November 2024, up to and including racing on 28 November 2024.
