Evidence:
Following the running of Race 7, the “TEAM WEALLENS 1600”, Mr Jones presented an Information charging Mr Mansour, the Rider of “MUSTANG VALLEY”, with a breach of Rule 638(3)(g)(ii), in that he struck his mount in consecutive strides near the 50 metre mark.
Mr Mansour admitted the breach.
Mr Jones illustrated the breach of the Rule from the race film, which depicted Mr Mansour, when leading the field approaching 50 metres from the finish, applying his whip in consecutive strides on one occasion. “MUSTANG VALLEY” went on to win the race.
Decision:
As the charge was admitted, it was deemed proved.
Submissions for Penalty:
Mr Dooley advised that Mr Mansour had a clear record for offences under the Whip Rule, although he received a warning on 21 September 2024.
Mr Mansour said his mount was hanging over the final stages of the race and his whip use was because he tried to correct this.
Reasons for Penalty:
The NZTR Penalty Guide provides for a starting point fine of $150. Although this was not a Black Type Group Race, it carried a stake of $80,000 and Mr Mansour’s percentage of the $46,000 winning stake was $2,300. An uplift of the $150 fine of $50 (that is one third), is required.
Conclusion:
Accordingly, Mr Mansour is fined $200.
