EVIDENCE:

Following the running of Race 8, Senior Stipendiary Steward Mr Steve Mulcay presented an Information alleging a breach of Rule 869(5) by Open Driver Mr Todd Mitchell (JOLIMONT), in that he half carted for a considerable distance passing the 1150m.

Rule 869(5) provides:

A driver shall trail with his horse’s head behind the seat of the sulky being trailed.

Mr Mitchell stated he was conversant with the Charge, the Rule and he confirmed his admission of the breach. Mr Mitchell was then excused from the hearing, as he had pressing duties at the stables.

Mr Mulcay played the race video and identified Mr Mitchell third last, entering the home straight, with a lap to run. He pointed to Mr Mitchell angle off the pylons approximately half way down the straight, into a position not on the pylons and not in the running line. He said the Stewards say he maintained this position for approximately 150m.

DECISION:

The Respondent having admitted the breach, it was deemed to be proved.

SUBMISSIONS FOR PENALTY:

Mr Mulcay stated Mr Mitchell had a clear record under the Rule and said the Stewards would be seeking a fine of $200 as per the Guidelines.

REASONS FOR PENALTY:

The video replay of the incident was very clear, showing Mr Mitchell deploying classic half carting strategy. Given this evidence, the Adjudicative Committee can see no reason to depart from the Guidelines on this occasion.

CONCLUSION:

Open Driver Mr Todd Mitchell is fined $200.
