Penalty: Apprentice Jockey Triston Moodley is suspended for 5 days

Evidence

Following the running of Race 8, the Respondent T Moodley Apprentice Rider admitted a charge alleging excessive whip use prior to the 100 metres.

Mr Moodley was assisted by Mr S Wenn.

Rule 638(3)(g)(i) provides that in a Flat Race a Rider must not:

(i) strike a horse with a whip more than 5 times prior to the 100-metre mark (other than in a slapping motion down the shoulder with the whip hand remaining on the reins); or

Using the available race films, Mr Jones demonstrated that the Respondent struck his mount 8 times from the straight entrance to the 100-metre mark.

In response, Mr Moodley said “I was not concentrating”.

Decision

As Mr Moodley admitted the breach, the Adjudicative Committee finds the breach proved (Rule 915(1)(d) refers).

Submissions for Penalty

Mr Jones produced the Respondent’s record, which indicated 1 previous breach within the rest period, which was for 9 strikes.

He referred to the Penalty Guide, which indicated a 5 day suspension in circumstances where the number of strikes is 3 more than permitted. Mr Jones invited the Adjudicative Committee to consider whether the fact he won the race, was an aggravating factor.

Mr Moodley sought a deferment to any proposed suspension to after racing on the 21st of September 2024.

Reasons for Penalty

The Penalty Guide starting point for a breach of this nature is a 3 day suspension.

The Adjudicative Committee did not consider the breach was a determinative factor in the result of the race.

Conclusion

Mr Moodley is suspended for 5 days, commencing after racing on 21/9/24 and concluding after racing on 29/9/24.
