Penalty: Apprentice Jockey Triston Moodley is suspended for 4 days

Evidence:

Following the running of Race 4, the “EMAC ELECTRICAL 1400”, Mr Dooley presented an Information charging Mr Moodley with careless riding in breach of Rule 638(1)(d).  It was alleged that Mr Moodley permitted his mount “PONTARDAWE” to shift outwards near the 150 metre mark when not sufficiently clear of “GOOD SPOT” (Mr R Elliot), dictating that horse’s line so as to move outwards onto, and to cause “IRRIGATE” to be checked.

Mr Moodley admitted the charge.

Mr Harris demonstrated how the movement outwards followed up Mr Moodley’s moving the whip from his left to his right hand in a manner which hampered his total control, so that ‘PONTARDAWE” drifted outwards into the line of “GOOD SPOT”, whose Rider Mr Elliot, was attempting to ‘take a gap’.

Decision:

As the charge was admitted, it was deemed proved.

Submissions for Penalty:

Mr Dooley expressed the view that the degree of carelessness was low range.  Mr Moodley has had 95 rides with 2 suspensions for breaches in the past 12 months.  Mr Harris said that Mr Moodley was a promising Apprentice and would learn from instructions on how to competently shift a whip from 2 hands.

Reasons for Penalty:

The Adjudicative Committee fixes a starting point of a suspension for 5 National Riding Days, allowing a discount of 1 day for Mr Moodley’s record.  He has riding commitments over the next few days.  The suspension is deferred until 7 October 2023.

Conclusion:

Accordingly, Mr Moodley’s Licence to ride is suspended for 4 National Riding Days, to commence at the conclusion of racing on 7 October 2023 and to end at the conclusion of racing on 13 October 2023.
