Manawatu RC 29 July 2021 – R2 (request for a ruling) – Dan O’Leary

SUMMARY OF FACTS: Mr Williamson informed the Adjudicative Committee that Mr O’Leary had two horses in the said race namely Captains Run (Horse Number 2 -Mr Mathew Cropp) and Elusive Ace (Horse Number 3 – Mr Reece Cole). Weighing out was 66.0 kg (Captains Run) and 66.6 kg (Elusive Ace). Upon returning to scale Mr Cropp weighed in at 64.8kg a difference of  – 1.2 kg. Mr Cole weighed in at 67.7 kg a difference of +1.1 kg. Captains Run crossed the line in 5th place.

EVIDENCE: Mr Williamson provided  a copy of the Clerk of Scales weigh in sheet confirming the aforementioned.

REASON FOR DECISION: The said rule 648(3) provides … if ,on being weighed in, the Rider cannot draw the proper weight the Clerk of the Scales shall allow such rider 0.5kg and if the allowance is not sufficient to enable the proper weight to be drawn then subject to sub-Rule(4) of this rule then in addition to any other penalty which may be imposed the horse shall be disqualified for the race.

REASON FOR PENALTY: The Committee are satisfied that evidence provided namely, The Clerk of Scales weigh in sheet is sufficient to enable  a ruling.

CONCLUSIONS: In accordance with Rule 648(3) Captains Run is disqualified from the Japac Homes Hurdles.
